FREQUENTLY ASKED QUESTIONS ABUSE AND LOSE Statutory Reference: 577.500 RSMo Q. When will I get my Missouri Driver’s License back? A. If you have met your reinstatement requirements, your license will be mailed back to you by the Director of Revenue along with your reinstatement notice after your suspension or revocation period has been served. Q. Can I have any type of driving privilege while I am revoked? A. You may be eligible to apply for a Limited Driving Privilege (Hardship License). Eligibility Under Missouri law, the reasons why you are not eligible for a Hardship License include, but are not limited to: 1. Already received a Hardship License within the last five year period. 2. Conviction for a felony involving the use of a motor vehicle. 3. Conviction for leaving the scene of a motor vehicle accident (does not include municipal or county convictions). 4. Two or more revocations for refusing a drug or alcohol test. 5. Disqualification of commercial driving privileges. 6. Conviction for driving a motor vehicle under the influence of drugs or controlled substances. 7. Multiple convictions involving alcohol or narcotic drugs. 8. Revocation for failure to pass a driving and/or medical examination as required by the Director of Revenue. 9. Suspension for an unsatisfied motor vehicle accident judgment (until payment has been made and/or compliance has been met). 10. Suspension for failure to pay ticket(s) in Missouri or in another state (until payment has been made and/or compliance has been met). 11. Less than 30 days have been served of a suspension/revocation that resulted from a conviction for DWI or BAC. 12. Less than 90 days have been served of a revocation for refusal to submit to drug or alcohol test. 13. Less than 30 days have been served of a Department of Revenue administrative alcohol suspension for driving a motor vehicle with a BAC over the legal limit. 14. The entire period of revocation has not been served of a Department of Revenue administrative alcohol revocation for driving a motor vehicle with a BAC over the legal limit. NOTE: Beginning August 28, 2001, if you are a prior or persistent offender, the court must order an ignition interlock device for any vehicle you drive. Therefore, you will be required to apply for a Hardship License in the circuit court in the county where you live or work. NOTE: Only one Hardship License can be given to you in a five-year period. If you don not currently have proof of liability insurance on file with the Driver and Vehicle Services Bureau, you will need to submit an SR-22 form from your insurance company with your application. Review of Application Typically, an application is reviewed within five business days by the Driver and Vehicle Services Bureau and an Order granting or denying the Hardship License will be mailed to you. Q. Will I have to retake my test? A. Yes, if your Missouri Driver’s License has been expired for more than six months. Q. Why do I need to complete SATOP? A. Missouri law requires that you complete SATOP for reinstatement if you violated any state, county, or municipal law involving the possession or use of a controlled substance, possession or use of alcohol, you committed an alcohol related traffic offense, alteration, modification, or misrepresentation of a driver license to operate a motor vehicle. Q. What is an SR-22? A. It is a form from your insurance company that shows your motor vehicle has liability insurance. Click here for an example of an SR-22 form. Q. When will the Abuse and Lose action come off my driving record? A. The Abuse and Lose action can only be removed after five years from the reinstatement date. You must submit a written request to the Director of Revenue requesting the Abuse and Lose action be removed. |
