Collaborative Law

St. Louis, Missouri, Collaborative Law Attorney

Collaborative law is a relatively new method of alternative dispute resolution (ADR) that is especially well-suited to resolve family law and divorce problems.

At The Marks Law Firm, L.L.C., we have the experience and training needed to make this process work for you and your family. We can help you understand how it works, help you identify important goals and help you minimize the long-term damage a divorce can cause you and your children.

Ending your marriage with dignity, with less stress and at a fraction of what you would pay to leave critical decisions about your future up to a judge is a real possibility. Talk to us about the mediation and collaborative law options. Call 314-993-6300 to schedule an initial consultation or, contact us online.

Which Approach Is Better, Mediation or Collaborative Law?

In practical terms, both approaches offer many of the same benefits — privacy, affordability, reduced stress, less risk, more flexibility and most importantly, the opportunity to shape your own futures.

So how do the two approaches differ? In divorce mediation, it's just you, your spouse and a neutral third-party mediator. If the process doesn't work, each of you goes back to your own attorney and starts preparing for trial.

With collaborative law, you and your spouse must agree to make good faith efforts toward a solution. Each of you must also have an attorney who is trained in the collaborative law approach. The four of you then sit down and try to resolve the key issues. This can happen in just one meeting if there are only one or two disputed issues, or through a series of meetings. If for some reason the process doesn't work, the collaborative law approach requires each of you to hire a new lawyer to represent you at trial. This provides both of you (and your attorneys too) with added incentive to make the process work.

See our Collaborative Law Information Center for more information about this approach.
