Child Support Modification

Because income and expenses can change over time, the court has provided a way to update the Child Support agreement by allowing either parent to file for a Modification of Child Support.

In order to seek a Modification based on a change in incomes, Missouri calls for a variation of at least twenty percent in the income used to calculate the current Child Support Judgment. When examining the request, the court is instructed to consider the following factors: the financial resources of both parties, the extent to which the reasonable expenses of either party could or should be shared by the person with whom he or she cohabits, and the earning capacity of an unemployed party.

Although there are guidelines in place, there are no hard and fast rules when it comes to Child Support Modifications and we recommend you seek experienced counsel to advise you on your options.
